1. Introduction and Agreement

Welcome to Dost, a multi-service platform operated by VOH Technologies (SMC-Private) Limited, a company incorporated under the laws of Pakistan ("we," "us," or "our").

These Terms and Conditions ("Terms") govern your access to and use of our mobile applications (Dost User, Dost Captain, Dost Partner) and website. By creating an account via Email, Mobile Number, Google, or Facebook, or by using any of our services, you agree to be bound by these Terms and the laws of Pakistan, specifically the Contract Act, 1872, and the Prevention of Electronic Crimes Act, 2016.

If you do not agree to these Terms, you must not use our services.

2. Definitions

• "Platform": Refers collectively to the Dost User App, Dost Captain App, Dost Partner App, and our website.
• "User": Any individual who downloads the Dost App to request services (rides, food, parcels, etc.).
• "Captain": An independent contractor (driver/rider) registered on the Dost Captain App to provide transportation or delivery services.
• "Partner": A third-party vendor (restaurant, grocery store, pharmacy, or service professional) registered on the Dost Partner App to sell goods or services.
• "Service": The facilitation of Rides, Delivery, Food, Grocery, Pharmacy, and Professional Services through the Platform.

3. Account Registration & Security

1. Eligibility: You must be at least 18 years old to use the Platform.
2. Account Creation: You may sign up using your Mobile Number, Email, or third-party accounts (Google/Facebook). You agree that the information provided is accurate and current.
3. Verification: We reserve the right to verify your identity using SMS OTP (One-Time Password) or by requesting documents (CNIC) where necessary.
4. Security: You are responsible for maintaining the confidentiality of your login credentials. You are liable for all activities that occur under your account.

4. Use of Services (Specific Verticals)

A. Ride-Hailing (Taxi/Bike)

• Intermediary Role: Dost creates a connection between the User and the Captain. We do not own the vehicles.
• User Conduct: Users must treat Captains with respect and must not damage the vehicle.
• Captain Status: Captains are independent service providers, not employees of VOH Technologies.

B. Delivery & Parcel

• Prohibited Items: You warrant that you will not use the Dost service to send:
  • Illegal drugs, narcotics, or alcohol.
  • Weapons, explosives, or hazardous materials.
  • Stolen goods or cash/jewelry exceeding reasonable limits.
• Inspection: We reserve the right to report any suspicious packages to law enforcement agencies in Pakistan.

C. Food, Grocery & E-Commerce

• Quality: The Partner (Vendor) is solely responsible for the quality, safety, and freshness of the food or products. Dost is not liable for food poisoning or defective goods.
• Availability: All orders are subject to acceptance by the Partner.

D. Pharmacy

• Prescriptions: Under the regulations of the Drug Regulatory Authority of Pakistan (DRAP), certain medicines require a valid doctor's prescription. You agree to upload a clear photo of your valid prescription when ordering such items.
• Liability: Dost acts only as a delivery agent. The dispensing of medicine is the responsibility of the licensed Pharmacy Partner.

E. Services (Handyman, Booking, etc.)

• Scope: Dost connects you with service professionals (plumbers, electricians, cleaners).
• Disputes: Any dispute regarding the quality of the service provided is between the User and the Professional. Dost will assist in mediation but holds no liability for damages caused by the Professional.

5. Payments and Pricing

1. Pricing: Prices for rides, food, and services are displayed on the app before booking. We reserve the right to adjust prices based on demand (surge pricing) or traffic conditions.
2. Payment Methods: We accept Cash on Delivery (COD), Wallet balance, and Credit/Debit Cards.
3. Refunds: Refunds are handled on a case-by-case basis. If an order is missing or incorrect, you must report it within 24 hours via the Help Center.
4. Taxes: All fees are inclusive of applicable taxes (Sales Tax/GST) as per Pakistan tax laws.

6. Cancellation Policy

• User Cancellation: You may cancel an order or ride before the Partner/Captain has accepted it. If you cancel after acceptance or arrival, a cancellation fee may apply.
• Platform Cancellation: We reserve the right to cancel any order if we suspect fraud, if the area is unserviceable, or if the Partner runs out of stock.

7. User Conduct & Prohibited Activities

You agree NOT to:

1. Use the Platform for any illegal purpose under Pakistani law.
2. Harass, threaten, or abuse Captains, Partners, or Customer Support agents.
3. Attempt to bypass the system to book Captains/Partners outside of the App ("cutting out the middleman").
4. Create fake accounts or use fake GPS locations.

Violation of these rules will result in an immediate and permanent ban.

8. Intellectual Property

All intellectual property rights, including the "Dost" logo, brand name, software code, and database, are the sole property of VOH Technologies (SMC-Private) Limited. You are granted a limited license to use the app for personal use only.

9. Limitation of Liability

Important: To the maximum extent permitted by law:

• VOH Technologies provides the Platform on an "AS IS" and "AS AVAILABLE" basis.
• We are not liable for any direct, indirect, or consequential damages arising from the use of the service, including but not limited to:
  • Personal injury or property damage during a ride.
  • Late food deliveries.
  • Services provided by third-party Partners.
• Our total liability for any claim shall not exceed the amount paid by you for the specific transaction in dispute.

10. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Islamic Republic of Pakistan. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts in [Insert Your City, e.g., Islamabad/Lahore].
